1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and Leazpass, Inc. ("Leazpass," "we," "our," or "us") governing your access to and use of the Leazpass tenant screening platform, website, and related services (collectively, the "Services").
By accessing or using our Services, you agree to be bound by these Terms. If you are using the Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Description of Services
Leazpass provides an AI-powered tenant screening platform that enables property managers to evaluate rental applicants. Our Services include:
- Consumer report procurement and delivery (credit reports, criminal background checks, eviction history)
- Identity verification services
- Income and employment verification
- AI-powered application scoring and decisioning
- Application management tools
- Compliance documentation and adverse action support
3. User Accounts
3.1 Account Registration
To access certain features of our Services, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.
3.2 Account Security
You are responsible for safeguarding your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access to or use of your account.
3.3 Account Termination
We reserve the right to suspend or terminate your account at any time for any reason, including violation of these Terms. You may terminate your account by contacting us at support@leazpass.com.
4. Property Manager Obligations
If you are a property manager using our Services, you agree to:
- Permissible Purpose: Only request consumer reports for permissible purposes under the FCRA, specifically for evaluating rental applications.
- Applicant Consent: Obtain proper written consent from applicants before requesting consumer reports.
- Adverse Action Compliance: Comply with all adverse action notice requirements under the FCRA and applicable state laws.
- Fair Housing Compliance: Use our Services in compliance with the Fair Housing Act and all applicable fair housing laws.
- Data Protection: Protect applicant information and not share consumer reports with unauthorized parties.
- Proper Disposal: Properly dispose of consumer report information in accordance with the FTC Disposal Rule.
- Certification: Complete our end-user certification and comply with all credentialing requirements.
5. Applicant Terms
If you are a rental applicant using our Services, you acknowledge and agree that:
- You authorize Leazpass to obtain consumer reports about you for tenant screening purposes.
- You consent to the collection and verification of your identity, income, employment, and background information.
- Your information will be shared with the property manager who requested the screening.
- You are providing accurate and truthful information in your application.
- You agree to pay applicable screening fees, which are non-refundable once the screening process begins.
6. Fees and Payment
6.1 Pricing
Current pricing is available on our website. We reserve the right to change our pricing at any time with reasonable notice.
6.2 Payment Terms
Fees are due at the time of service unless otherwise agreed in writing. We accept payment via credit card and other methods as indicated on our platform.
6.3 Refunds
Screening fees are generally non-refundable once the screening process has begun. Refund requests for other services will be evaluated on a case-by-case basis.
7. FCRA Compliance
Leazpass is a consumer reporting agency under the Fair Credit Reporting Act (FCRA). As such:
- We follow reasonable procedures to ensure maximum possible accuracy of information in consumer reports.
- We provide required disclosures to consumers.
- We investigate and resolve disputes in accordance with FCRA requirements.
- We limit the furnishing of consumer reports to parties with a permissible purpose.
- We maintain appropriate data security measures.
8. AI-Powered Features
Our Services include AI-powered scoring and decisioning features. You acknowledge that:
- AI recommendations are provided as decision-support tools and do not constitute legal advice.
- Property managers retain full responsibility for final rental decisions.
- AI scores are based on configurable criteria and objective data inputs.
- We do not guarantee any specific outcomes from using AI features.
- You should review AI recommendations in conjunction with all available information.
9. Prohibited Uses
You agree not to use our Services to:
- Obtain consumer reports for any purpose other than evaluating rental applications.
- Discriminate against any person in violation of fair housing laws.
- Submit false or misleading information.
- Attempt to circumvent any security features of the Services.
- Access or use the Services through automated means (bots, scrapers) without our permission.
- Violate any applicable laws, regulations, or third-party rights.
- Share consumer reports with unauthorized parties.
- Use the Services to harass, abuse, or harm any person.
10. Intellectual Property
10.1 Our Intellectual Property
The Services, including all content, features, and functionality, are owned by Leazpass and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Services without our prior written consent.
10.2 Feedback
If you provide us with feedback or suggestions regarding our Services, you grant us a non-exclusive, royalty-free, worldwide license to use and incorporate such feedback into our Services.
11. Third-Party Services
Our Services integrate with third-party services including TransUnion, Plaid, and payment processors. Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the actions or omissions of these third parties.
12. Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
We do not warrant that:
- The Services will be uninterrupted, timely, secure, or error-free.
- The information provided through the Services will be accurate or complete.
- Any errors in the Services will be corrected.
- The Services will meet your specific requirements.
Consumer report information is obtained from third-party sources and we cannot guarantee its accuracy. You are responsible for verifying information independently.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LEAZPASS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL.
Our total liability for any claims arising from or related to these Terms or the Services shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) $100.
14. Indemnification
You agree to indemnify, defend, and hold harmless Leazpass and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of the Services, your violation of these Terms, or your violation of any rights of another party.
15. Dispute Resolution
15.1 Arbitration Agreement
Any dispute arising out of or relating to these Terms or the Services shall be resolved through binding arbitration in accordance with the American Arbitration Association's Commercial Arbitration Rules. The arbitration shall be conducted in Houston, Texas.
15.2 Class Action Waiver
You agree that any arbitration or proceeding shall be limited to the dispute between us and you individually. You waive any right to participate in a class action lawsuit or class-wide arbitration.
15.3 Exceptions
Either party may seek injunctive relief in any court of competent jurisdiction for any actual or alleged infringement of intellectual property rights.
16. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. To the extent litigation is permitted under these Terms, you consent to the exclusive jurisdiction of the federal and state courts located in Harris County, Texas.
17. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Services after such changes constitutes your acceptance of the new Terms.
18. Miscellaneous
18.1 Entire Agreement
These Terms, together with our Privacy Policy and any other agreements incorporated by reference, constitute the entire agreement between you and Leazpass regarding the Services.
18.2 Severability
If any provision of these Terms is held to be unenforceable, that provision shall be modified to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
18.3 Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
18.4 Assignment
You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign these Terms without restriction.
